What should i settle for?

was a 22 year old passenger in a single car accident that broke my femur which resulted in 3 nights in the hospital and sugury to place a rod and screw put in my leg. I was off work for 3 1/2 months and had to go through a month of theropy before returning to work. Medical bills approx. 30k, and lost wages of around $4500. I am almost ready to settle with the insurance and would like to know where to start? What kind of settlement am i looking at? I was wondering where to start when the offering comes.... does it matter if he was drinking and driving and driving wrecklessly? didnt get a DUI though, got physical control. His coverages is 100 300 50...i would like to know a round about estimate of what I am expected to get so I know what to settle for. I talked to a lawyer and she said go for the limits...so after my bills that would leave about 70k, would the insurance settle for that?

Credit Cards Offer Discounts on Medical Expenses

We all may get some help on the soaring cost of health insurance and prescription cost by a surprising source, our credit cards. : Even healthy consumers feel the pain of skyrocketing health-care costs. A family of four pays nearly $3,300 in insurance premiums each year, according to Kaiser Family Foundation, a nonprofit health policy and research firm. Tack on deductibles, co-payments, prescription drugs and uncovered services, and the bill is closer to $6,700. Some relief is being offered by a surprising source: credit cards. Now, consumers can earn cash for their health-savings accounts, and discounts on prescriptions, as well as dental and vision care by paying for their medical expenses with plastic. Bank of America offers two such credit cards. Citibank's card offers discounts of up to 60% on prescription drugs. HSBC is market testing a debit card linked to drugstore CVS's Extra Care rewards program. Even Target is in the game, offering a 10% discount coupon for every 10 prescriptions filled and paid for with your store credit card. : Used wisely, however, these cards can offer decent savings for cardholders. With the Citi Professional card (see chart), for example, an uninsured consumer could pay just $158.45 at CVS for a 60-dose disk of asthma med Advair and#8212; a 12% discount off the regular price of $180.99. Assuming the inhaler is used twice a day, the savings would come to $270.48 over the course of a year. With the Aetna Healthy Living card (see chart), the average $2,081 paid out of pocket to heal a compound leg fracture would garner a $25 rebate check. It appears that CVS Drugstore is one of the test markets for this.

Another beneficiary contestment

Hi guys, As you might know I am contesting the beneficiary change (from 1995) of my late father (I was his original beneficiary). Currently, his ex wife (they divorced in 1999) is listed as his beneficiary. I believe that I was change back to beneficiary in 1999 (the year they were divorced and the year I turned 1 and that either the local represenative or the home office has misplaced this amendment and never had it recorded. The insurance company said that I can also file a claim for the policy even though I am not who they show as beneficiary. You see I have the original policy and I am his only relative therefore I am supposed to be the only person who can get certified death certificates. They of course want me to send them these things. Does this sound fishy to anyone else? I am kind of wondering how hard they are really going to look for the andquot;lostandquot; amendment? If it is found would they not be considered negligent for losing it and making me go through all of this? Also they sent my attorneys a copy of the beneficiary form that changed my dad's ex-wife to beneficiary. It also looks a little strange to me. My step-mother filled out the entire form. My dad only signed the bottom. Also he checked boxed to change the billing address and the beneficiary on the same form. I would hope my step mother would not have done this but at this point I am not putting anything past her. How do I know that my dad didn't think he was signing a change of address form and then she went back and changed herself to beneficiary before it was mailed off? I mean this women truely is evil and she knows this money is intended for me (my father's only child and basically his only living relative) Also would this matter to a court. I have a hand written letter from my step-mother that she wrote when she left my father. My dad had to go out of the state for a week for training for work. I was 17 and was staying at home with my step mother. I went to school on Mon. and when I came home there was nothing in my house except for this note. She took all the furniture, the dishes, even all the food. It was this note and a phone in the floor. In the note she repeatedly states she doesn't want anything but what she has already taken. She goes on to state that I won and now I have my daddy's time, house, and money. Does this letter mean anything? She also requests him to lie (which he did) and say they have been seperated for a year so that their divoce would go through immediatly. They were only married for 3 1/2 years.

I don�t want the Ins co. to total out my cash car.

I live in Dallas TX and drive a 1995 Grand AM SE 4 door Power doors and locks. I paid $2000.00 for the car in 2006. I can�t afford a car note at this time. I was hit by this cowboy in an F150. He was at fault and his ins co. has accepted liability. (by the way his truck is just fine) It will cost $2160.00 to fix my car according to his insurance company certified repair company S-King. The only damage is to the front drivers side panel, bumper head light and hub cap. My car is drivable and runs just fine. The Ins co. wants to total out my car and give me $800.00. l I cannot buy another cash car for $800.00 which means if I give them my car, how will I get to work? Pick up my kids LIVE MY LIFE! I refused and told them I want to keep my car and that they need to pay for Cowboy negligence. Do I have to give them my car and take the $800.00? Can I make them repair my car? I was minding my own business when I got hit by the cowboy and now Farmers Ins it trying to put me I the poor house. Stressed.

Wife in Car accident, we have no insurance, help!?

Here's my situation, I have no help/advice from anyone on what to do, so I need legal type advice! We live in Florida. My wife got into an accident last week, and her can was undrivable from the scene. NOBODY was hurt. THe other driver was able to drive the car away from the scene. My wife was entering an intersection, where another driver signaled her to 'go ahead' and she procedeed to turn into the intersection, when another driver hit my wife's car. The officer arriving on the scene gave my wife a failure to yeild ticket. The other driver received a ticket for statute FL322.34(2) DNLS knowingly, which seems to be for driving with a suspended license (for a DUI or something similar). My wife called me about the accident and it turns out that after calling my insurance company (progressive) we had missed a payment, which coincided with the end of a policy/start of a new one. They never sent a missed payment notice, because one policy(6mo period) expired and there was no missed payment notice to send becuase we had not started our new policy without that 'missed' payment, so we were informed that we were uninsured during the period of the accident (totally unknown to us, and unfortunate for us). So, the owner of the other vehicle (not the driver) wants us to pay his $1000 deductible for the accident, which of course we don't have. I'm not sure how to handle this? Are we totally responsible for 100% of the fault here?? Does she get assigned any percentage of the fault due? What about the fact that she was driving with a susupended license and shouldn't have been on the road at all? Can someone help me with answers to those questions? Thanks! captainejo@hotmail.com

Total Loss ACV vs Settlement value

Hi, I recently purchased a Honda Accord EX-L 2008 model on Dec-26, 2007. Unfortunately I met with an accident on the 14th of Jan 2008 (my fault) and I have comprehensive collision and damage coverage and also GAP insurance since I financed the car. The insurance company has declared my car TOTAL. I inspected the car and the front guard, the bonet, right side mirror, and lamps are totally damaged. The radioator is damaged and I believe there is a damage with the a/c hose pipes. The right side of the car has dents and needs painting. I believe there is no damage to the engine or interior. I am not satisfied with the decision as I believe the car is still repairable and I dont know what the ACV will turn out to be. The insurance person told me that the cost in fixing the car will be around $13000 which includes any suspected hidden damages (estimated). Can someone put complete focus on what steps should I take and if the car is really a total loss then what is the best deal I should expect based on the make/model/200 miles/and the description of damages? How long does it take for the cheque to reach the bank if its a total loss, since after that only I can go for GAP and GAP has a time limit of 90 days from the date of accident. Please provide me as much information as possible since I am new to USA and do not know many things which I can easily overlook. Thanks for the replies in advance.

Can I switch to another auto insurance company?

My current auto insurance carrier is Geico in California. I had an at- fault accident in last Nov and the claim that I filed to Geico is still open because in the accident there were totally three cars involved and one of the other two persons never spoke to my insurance company and claimed anything. My coverage is enough in case that person comes back. Due to this accident, my premium is dramatically increased. I got several much lower quotes from other auto insurance companies for my next renewal in mid Feb. My question is: if I change to another auto insurance company while the claim is still open, will Geico still take care of the claim, i.e., pay the person if he comes back? Head on accident

I was involved in a head on that was the other drivers fault: I was driving north they were coming south. They lost control of their vehicle on slick roads and crossed the center line in front of me where hit them in the door. The other vehicles passenger was killed, myself and my passenger were seriously hurt. My injuries include a broken scapula, a compression fracture on my L2 vertebrae, fractured elbow,sprained ankle, among other soft tissue tears and bruises. The other drivers total coverage is $100,000 for the total accident. Their insurer admitted liability(as the case is pretty cut and dry, even in the newspaper press releases and TV news stories) and says there is no way their insurance was enough to cover all damages, physical as well as property. They are going to fax a declaration page over to my insurance, so that we can open the underinsured part of my policy.My uninsured/underinsured is $100,000 per person with a total of $300,000. Since this was such a serious accident will my insurance company just cut a check for the Limits to get this out of their hair? This has put my wife and I in a serious bind, as I am now laid up and we have no income for car payments, mortgage payments and such. Thanks in advance. M

This may sound cold

But I was wondering how would one go about taking out life insurance on a relative.I know this may sound cold , but its like taking out insurance on your child,no worse. My mother in-law is about 65 now she has her own insurance but would it be possible to get a life insurance policy on her also.I wanted to get one on my dad, but the best i could remember was they wanted his social security number and I did not know it. I also did not know how to go about getting it without him knowing what i was doing.He wanted so bad to leave us something but his second wife got it all then when she died it went to HER kids.We got nothing! So thats what happens most of the time if there is no will .Sometimes if there is one people fight over things, I would just as soon make and pay for in premiums my own inheritance.Does sounds bad.

Life Insurance Guidance

When it comes to life insurance on your children, how much do you advise that you take out. I have two children still at home and would like to insure myself along with my children. My oldest is out on his own and doing well. My kids and I are all three healthy, I thought about taking out a small policy on each child and a bigger one on myself and naming my daughter that is still at home the beneficiary, she is going to graduate this year and move on to college, she will probably live at home while she is in school, so if something would happen to me, I want my children to be covered and not loose their home and everything that we have worked for. They are good kids, with good grades and participate in many community activities with me. I have a great relationship with all three of my kids and donÂ't want them to worry about this sort of stuff, in fact I donÂ't want to discuss it with them, I feel it is not appropriate. I am looking for guidance on how much to take out and what type, I have been reading through the forum and see there are at least two different types of insurance that I could possibly purchase. I want to make the right choice, would appreciate any advice you have to give. Thank you August.

Fair compensation??

Hello I live in CA and last year a man driving an SVU sped out of his driveway and collided with me. Luckily neither of us were badly hurt, so it seemed at the time. The following day I couldn't bend down. I called my lawyer who sent me to a doctor who determined that I had severe visible muscle spasm in my lumber region and recommended about 6 or so months. An MRI was also ordered which confirmed 3 herniated discs. Nothing too major, but major enough that I still get occasional pangs, and was pretty much unable to sit for the first month. The car damages were about $2K. The other motorist was unisured. My uninsured motorist coverage is $30K. My lawyer recently called and stated that they would like to settle for $7,500. What seems unreasonable to me was that she told me that since I am overweight, the medical experts determined that the impact of the crash could not have possibly caused the extent of injuries which I sustained, therefore I must've had some prior damages, and the amount was lowered. I asked her if they are in possession of any prior Xrays or MRIs that they had to juxtapose this and she stated that she did not know as they would not show her the file . Her opinion was to settle and move on, which part of me agrees with, but the low amount of money seems to have a shady basis. Even if we assume that I have had previous injuries, since his negligence is the cause ofworsening a pre-existing condition, aren't I entitled to full compensation? Wasnt that the andquot;eggshellandquot; ruling?? Thanks.

Total Valuation Loss Discrepancy

Are insured entitled under any law to obtain 3 estimates on a car's value if they don't trust the insurance company's paid adjuster (who renews his contract with the company only by saving them money, not by costing them money). A friend's brother-in-law ran my car's value on NADA and came up with a value of roughly $5700 and my insurance company's adjuster is saying it is worth $4100. It's a 1999 toyota camry le 4dr sedan; 4 cyl., 2.2 liter. It's options are: automatic transmission, air conditioning, power driver's seat, heated back glass with antenna, electric remote control mirrors, cruise control, power windows and doors. No moon or sun roof. It has $159,600 miles on it but was in excellent condition prior to the accident-- even brand new tires and wiper blades; but the adjuster won't list it as anything better than andquot;goodandquot; condition in obtaining his figures. (Of course, after being totaled it isn't in andquot;goodandquot; condition either, but that's as good as the adjuster will go.) Is there a way to contest the company's adjuster's value? Do I have a right to get other estimates on the car's value? Is the $5700 NADA value my friend's brother in law gave me in the correct ballpark instead of this $4100 stuff the insurance company is trying to tell me? Further, because I like the car and want to keep it and fix it they want to knock an additional $1200 off of their settlement check. (Initially they said it would be $800 to $1000 and my wife and I wanted to discuss the offer first. When we talked to the company the next time they said they had made a mistake and that they were taking $1400 off because we were keeping the car. We said that if the car was suddenly worth that much more that they were losing an extra $400 to $600 by letting us keep it that the car's actual value must be more than the $4100 they were trying to tell us and that they therefore ought to be reevaluating the car's value (up) before taking the $1400 off. They went only far enough to say that they would be doing us a HUGE favor, but were willing to adjust their withheld total down from $1400 to $1200. The whole negotiation with them has been nothing but swinging at a moving target and I can't help the feeling that we're getting a royal screw job. The company is urgently trying to settle the claim and pressure us into taking the deal and my wife wants to because she is just tired of fighting it (I'm sure the insurance company depends on that), but I always want to fight harder when I think I'm getting a financial screw job. Any guidance from the experts that might help??? thanks!

Can I Sue My Insurance Customer?

Recently I wrote a home insurance policy on a customer who told me he had no trampoline on his property. He signed the home insurance application that stated andquot;No trampoline on the propertyandquot;. When the insurance company inspected the property, guess what? - they found a trampoline in the customer's back yard. Prior to the time the insured received the andquot;Notice to Cancelandquot; from the insurance company, there was an accident involving the trampoline, which seriously injured a neighbor's child. The customer called the insurance agent to report a claim and the agent advised the customer that since there was a andquot;material misrepresentationandquot; on the original application, the insurance company intended to cancel the policy back to the date of issue (as though it never happened). The customer was very angry and advised the agent that he was going to see his attorney. A few days later, an article appeared in the local newspaper which actually andquot;slanderedandquot; both the insurance company and the agent. Can the agent sue the customer for andquot;slanderandquot; or andquot;defamation of characterandquot;?

MVA with unique circumstances

Two months ago I was in an MVA in which I was not at fault. First, my unique situation: I am a C5 quadraplegic that is wheelchair bound. Of my limbs, I am strictly dependent upon my right arm and right leg. On my right hand, only my thumb, index finger and pinky finger are functional. With all that said, I lead a fairly independent life as stand up comic (in addition to a part time day job). I drive a modified Chevy Uplander with a dropped floor and a ramp that folds out. I drive the vehicle in my power chair, as it simply pulls up to the steering wheel. In my accident I was driving 40 mph in the middle lane. The at fault driver came to a stop sign and then proceded into the road. I hit him flush in the driver's side of his SUV. Both airbags deployed. The dash was crushed into my right knee and the airbag deployed on my right hand. I was taken to the hospital in an ambulance. The driver took full responsibility as did his insurance company. At the ER they did not initially see any breaks/fractures (though they did note my right knee was swollen) and sent me home. Once home I realized my right hand wouldn't work right. I couldn't grip, type or write (for what it's worth, someone else typed this). My pinky finger was incredibly weak and wouldn't function as usual. To the average person that may seem insignificant. To me, it's devestating when you already have a limited infrastructure. After a week my knee kept swelling. Ultimately seperate orthopaedic surgeons diagnosed me with a non-displaced fracture in my right leg and ligament damage in my right hand. They immobilized my right hand and leg (which, for me, is tantamount to total paralysis). After adequate healing time they are recommending 3-4 months of PT/OT for my hand and leg to regain range, strength and general use. There was $14,000 worth of damage to my vehicle (which does not include the modifications). There was an additional $1500 in damage to my wheelchair and $1000 dollars in medical bills. I am only able to prove lost wages from my part-time job of $1400. What should I expect from this situation? Thank you in advance.

Insurance settlements and payment for medical bills

I was involved with a third party car accident. They are calling it a low impact accident since my car had $650 in damage. However, it didn't feel low impact and I was diagnosed with whiplash. I've been receiving treatment and my medical bills are approximately $4900. I'm in the process of trying to settle with the insurance company. I've been reading I should ask for 3 times my medical bills as a starting point. Should that include the payment of the medical expenses or not? What is a fair and reasonable settlement. I still have neck pain and I fly a lot for work which adds to the issue. I'm a supervisor for a multinational engineering firm. I'm never had an injury related car accident claim before and looking for advice.

My boss hit my car.

My boss hit my car. It was an accident and I understand that. Everyone makes mistakes, especially if they have way to much going on. my question is... I would like to know how much the insurance company is planing on paying me. My boss uses AAA as her insurance company the damage is worth about 2000 dollars and I live in Michigan. I drive a 96 monta carlo. I know it seams absurd to ask this question but I feel like my boss is trying to cheat me out of the money I should actually be getting. If anyone has any Idea of a general amount please let me know. I would rather know if I am right or not then to confront my boss and have it tern out as some huge mistake.

If andquot;YESandquot;, why? If andquot;NOandquot;, why not?

My Husband's car was vandalized

My husbands car was vandalized we think when he was at his grandmother's house. He didn't notice any damage until he got inside of his car - the headliner was down on the inside. He didn't think much of it since it's an older car and figured he would deal with it in the morning. When I went out to the car in the morning to take my son to school, I noticed that the entire outside of the car was really scratched up and then when I got inside, I noticed the seats had been torn. Initially, the insurance company processed the claim but recently transferred it to the andquot;special investigations departmentandquot; for investigation! Why would they do this? We did recently add comp and collision to his car because we were having twins and increased all of our insurance. Would this play a part in them transferring it? Why is this happening to my family?

Auto Insurance Claim: Problem Here

I live in Pennsylvania, which is under a 'No Fault' system. What happened was me, along with 3 friends were involved in a car accident;my friend was the driver. A car hit us from the side, hitting the front of our car, and we had the green light. The driver of the other car was technically at fault, and now the real problem I'm facing is this: We all went to the ER to get checked on, the bill comes to us, my friend tells me he's claimed us all into his insurance for medical coverage, BUT his insurance tells him that because it's a no-fault law, we are each suppose to claim the accident ourselves to our own insurance/parents insurance...which doesn't make sense to me at all. His company is Allstate, and I've talked to the representative and did my research. According to the representative, if I claim with my dad's auto insurance, the bill will be taken care of and his premium will not rise, but where's the logic? Why would my dad have to claim me if it had nothing to do with me when the responsibility is on my friend? Plus, he(dad) called his company and they told him his premium would rise. So now i am stuck, and unsure of what to do. The bill itself is $800.00 and there is no reason why I should pay out of my own pocket or increase my dads premium because of this. Can anyone provide any help as to what I should do..? Why isn't the driver allowed to claim all of us in his medical coverage? Why do we each need to claim this separately to our own coverage when the driver is to be responsible? thanks for any comments

Car may be totaled after repairs

Hello, My wife hit a deer in October of 2007. The car is a 2005 VW Passat TDI that is pretty hard to find. The repair costs have risen from $3000 to over $12000. The car had to go to the dealership for repairs the bodyshop could not do. This week, we found out that the car will not drive and that the transmission needs replacing. The body shop representative said that the insurance company seemed to be in the process of totaling the car. We have not gotten word from the insurance company and they have not returned calls. My question is this: I got a good deal on the car and I'm not andquot;upside downandquot; on it. All of the body work and engine work has been done. Would it be a good decision for me to keep the car, provided the insurance company makes a good offer as to the salvage value and have the transmission repaired or replaced? I keep cars for a long time and have no problem with having a salvage title. What step should I take next?

car accident

About 6 months ago I was invovled in a car accident. A lady driving too fast for weather conditions totaled my truck with her car and was cited on scene. My jaw was slightly disaligned for which I now wear a retainer at night, whiplash and right arm trauma (used it to block the airbag). What I thought was going to be a quick recovery turned into a nightmare. After months of Phy. therapy, chiropractic care and medical test I was finally diagnosed with RSD (chronic pain syndrome) in my right arm. It is still very swollen and slightly discolored and they say this is all the better it will get and may actually worsen in time. Tomorrow I go to the pain clinic to find ways to manage the pain. This coluldn't happened at a worse time since my husband and I was building a home and both HAD to be working. Now I am buries in finacial woes and get depressed thinking that it is really going to be never ending since my earning capacity is knocked to nothing. My right arm is my dominant one and my job requires a lot of lifting and physical ability (when and if I ever can do it again). I was released to light duty before being diagnosed with the RSD but my job was done for the year . I usually spend every winter working part time at a clothing store, then in the spring return to the greenhouse. Does anyone have any idea how long a claim like this will take to settle? I hear when your done doctoring but in my case that will never be. What is a amount that I can expect from this claim? I really need to shed some light down this dark hole.

How should we handle this?

My dad was in an accident... - Other driver T-Boned him - Other driver was at fault, we live in OR. Witnesses, Police Report - We have liability with Allstate, other driver has Progressive Our Truck 1998 Ford F-150, 120k miles. - They are offering us 2,200 for the truck + 1 week paid for rental - We are now out having to pay for another rental while shopping for anther truck that is going to cost us another 5-7k on top of the 2k they are offering us. Since the other driver was at fault, all medical bills are being paid by the other guys insurance. My dad has some whiplash, pulled tendons in both arms, and alot of discomfort but not enough pain to miss work. My question: What can we do to get the money for the new truck, the rental car, time spent having to shop for a new truck, and pain and suffering from the accident? - We are thinking somewhere from 5-10k total, but we are not sure how this stuff works. What about getting an accident attorney, or take them to small claims court. Any advice would be welcomed

! NEED HELP--insurance for total loss

Hi, everyone I had a car accident three days ago, just got dicharged from the hospital. I called the insurance company today and they said the car is a total loss (i haven't seen it after the accident). They are going to cut me a cheque with BOTH the bank(leinholder) and my name on it. The amount will be the sale value $20,000. I've only had the car for 1 months (isn't that sad?), and I still owe the bank about $22,000 as of now (including interest and other charges). I understand the bank has the right to collect the money before me since they own a larger portion of the car than I do, but is there any way that I can keep the cheque and keep paying off the loan monthly??? i can't accept the fact that I will be left with NO CAR, NO MONEY, $ 2000 DEBT, a CONCUSION, and NO WEDGES for the next 3 weeks! I know some of you guys are very experienced adjusters, have you ever dealt with anything like this? Is there another way around this? ---- at least let me keep 1/2 of the cheque and pay the rest of the loan by montly as before. Thank you so much!!!!!!!!!! I really need your advices!!!

Hit 1 month ago and other part calls just now..

hi, i currently need help with my problem. 1 month ago i was at fault at a very minor car accident. i was reversing at a parking lot, and from my blind spot a car comes rushing through and hits my bumper, there are no dents after the hit just paint scraped on my bumper and his 2 doors. i didnt really find the dmg that big of deal so didnt realy mind so much. and it seemed he didnt either, we just got each others names and numbers and license number..no insurance information was traded i thought he would call me after a day(no report was made at the site), or so but he didnt, so i went ahead and repaired my own dmges to my car which was just paint. 1 month later from the accident he calls me wanting to settle the accident and file a claim and everything, but im already past it and have repaired my car. so my question is isnt he to late to file a claim? do i have to continue discussing the issue with him? all he has on me is my name number and license... can he take legal action on me with just that? so should i actually continue to file the insurance claim or wil it b safe for me to leave it alone? thank you for ur advice

What do I do??? Please help !!!

I just want to say this is my first post and it is a messy situation so any advice would be much appreciated. I was involved in a two car accident in May 2007. The driver of the other car had a stop sign and stopped quickly and preceded into the intersection as I was crossing the intersection, I had no stop sign. I hit her back passenger door. The police were contacted but did not come due to a high speed chase in the area. So there is no accident report. We exchanged information and she drove away and I had my car towed. Long story short my claim was denied by her insurance company. I have been making my monthly car payments on the car as it sits in a junkyard. Her insurance company is now taking me to arbitration court for damages to her car, now seven months later. I am now sitting here seven months later with a denied claim and still making payments, is my insurance company responsible for any of the damages. I did have full coverage and Minnesota it is no-fault state. I am just wondering what I can do.... Any advice or suggestions would be great!! I am just fed up with my insurance company and just want to resolve this.

Home Owners insurance

I am in a rent to own situation, I carry my own insurance on the home, about a month ago I came home to find a pick up truck in the middle of my deck that was just finished two weeks before that, I had not even had time to get furniture on it yet. I could have just cried, all the hard work in the evenings after work and on the weekends all shifted and crooked. The truck also shifted my chimney over. I want the insurance company to pay for the repairs on the chimney too, the impact knocked items off my walls and kitchen counters, I am really surprised that the truck did not come through my kitchen. The individuals car insurance wants to settle the claim for $4000, I have almost that in the deck in the treated lumber, it is a pretty big deck with a ramp leading up to it. It sits second story. I am not happy with this amount, so my question is, will my homeowners step in and make the car insurance company pay for the other damage to the home, chimney and such. They will be the ones insuring the damaged property so I would think that they would have some interest in making sure the repairs are done right. I am asking for any advice at all here, dealing with two different worlds of insurance is confusing me car insurance vs homeowners insurance. thank you in advance for any advice you can offer.

A heck of a mess (Estate/Insurance)

My grandfather died in September. I am the executor's (my father's) designee for the purposes of handling the massive amount of paperwork my grandfather has amassed over the years pertaining to life insurance. I have boxes full of policies, certificates, letters about policies transferring from one carrier to another- and a lot of advertisements for insurance products grandpa may or may not have purchased. As I sift throught the stacks, I am calling insurance companies with regard to specific policy numbers because I don't know how else to go about it. I have found a good bit of active insurance, but I have found a whole lot of inactive policies, too- ones that have either been paid off, have lapsed, or have been surrendered. I've long since sorted the paperwork as best I could, but the other day I called an insurance company in regard to a specific policy only to find out grandpa had two other insurance policies with them which were in force at the time of his death. I have been through every sheet of paper in these boxes trying to find paperwork for these policies. It just isn't there. I've said all that in order to ask this question: Because I am concerned that there are policies in force for which I have no paperwork, how can I go about finding out about these policies? It almost seems like a fool's errand to continue in this manner. (I am trying to get a list of his bank account activity in the months before his death and records from his dozens of credit cards in order to determine to whom he was making his premium payments, but I am concerned about paid off policies and companies with policies on Grandpa who don't have his most recent address.) Any ideas would be much appreciated.

Carrier using injury rating computer programs

This is really an industry question but I'll also explain some background: Adjusters know that some insurance companies use software programs (COA, Colossus, etc) to determine a range that an injury claims usually settles for. The adjuster inputs all of the injury information and the location of the accident and the program spits out a settlement range. Insurance companies who use these programs _claim_ that this range is just used as a reference to help the adjuster. They have to claim that, as requiring adjusters to settle within a computer generated range is illegal and carriers have lost lawsuits based on this issue. That is, the argument is that a computer program cannot account for all the issues that need to be addressed in an injury claim. My view... I'm _100%_ against any carrier using these programs. Of course the ones that do, claim that it _is_ just a andquot;toolandquot; but anyone with any brains has/can see that it is not. In my last job the carrier was all about making reports look good. I received and kept an email from the Regional Manager in which he showed a chart or percentages in which adjusters settled below, within, and above the computer generated ranges. He complained that this year the percentages of times adjusters settled above the range increased. He then explained when an adjusters percentage of settlements above the range reached 35%, he'd send an email to that adjuster. Now we all know this email would not be sent for the fun of it... that is, it would require some action by the adjuster. So while the carriers state that the computer generated ranges are simply andquot;guidesandquot;, anyone who believes this is fooling themselves or just in denial. Also, and this is more important, the computer generated range is only as good as the information put into the program. Any adjuster who has ever used one of these programs knows that some information just does not fit into the program. Most adjusters also don't know enough about the way the program works to put in accurate information (i.e. some programs don't allow ER visits to be imputed as they are assumed based on other entries, some systems require that certain types of visits be grouped together and inputed as 1 item, etc). If I asked 10 adjusters to enter the same medical information, there would be 10 different settlement ranges. If an adjuster is put into the position of needing such a tool in order to determine what a good settlement would be... they should not be settling injury claims. I understand that at some point an adjuster needs to take a leap and _start_ handling these claims but they should then be reviewing the injury claim with other adjusters or a supervisor. Does it make any sense that this adjuster does not know what a good settlement should be but they are relied upon to input 100% correct information into a computer program? Personally... as an adjuster working for insurance companies (and I love the industry). I'd be 100% behind any lawsuit against a company for using these programs. It's the only way to get them to stop. Now that I've filled 5 paragraphs with my utter hate for these programs... anyone want to disagree? I think it might be obvious that I won't agree with any counter views but I'd also be an idiot for not listening with an open mind. Any comments?

Will insurance company will total my car???

I have a '99 Pontiac Grand Am GT, approx 115,000 miles on it, power windows/locks, cruise control, am/fm/single cd, a/c, bra, rear spoiler, brand new tires bought about 3 months before the accident, alloy wheels, abs etc. (my dream car!!) I was involved in an at-fault accident andamp; have been given an estimate for repairs of $3674.16 (all front end damage) We are waiting to hear from the insuarance company right now. I am concerned that the insurance company might total my car. This car had absolutely no body damage before the accident andamp; my husband andamp; I had just put $600 in tires on it and have spent almost $1000 over the last year in repairs (to the engine etc). I live in Oregon andamp; am having a hard time finding out where I stand with this. If they total my car I understand that I can get a salvaged title but will I still be able to get full coverage insurance (I have quite a bit of insurance coverage on it right now) or will I only be able to get liability??
