Accident, no ticket, no insurance in effect

I was in an auto accident in Dec., 07. I didn't get a ticket and the police report said that I had not caused it but stated the other driver was andquot;innattentiveandquot;. I rearended them. The car was not the drivers and both driver and passenger went to the hosptital, however I don't know the extent of any injuries. I called to report the accident to my insurance co and learned that my insurance had lapsed due to nonpayment. They reinstated it the following day. One of the people in the accident now has an attorney stating that if I don't show proof of insurance, which I cannot, they will go to the state (I live in MO) and ask that my license be suspended until I pay her damages. Can this be settled w/o the state getting involved? I can't afford an attorney and AM keeping my insurance paid. Any advice would be appreciated.

Son borrowed car and let friend drive-friend hit someone

My son is a licensed driver and insured under my policy - he's 17. He used my car yesterday and, unbeknownst to me, let his friend borrow the car. The friend hit a pedestrian and sped off. When my son found out he went to the scene of the accident and called the police. I'm freaking out here. My son got a ticket for allowing someone without a proper license (the friend is 16 and has a learner's permit.) The friend was arrested. I'm worried that my insurance is not going to cover this -they have yet to return my call. I am a single mom and do not own a home and have no assets. In fact my company just closed down after 30 years and I am getting by on unemployment. I'm afraid, considering the circumstances, that my insurance will not cover this accident and I will be sued. I have no money and don't know what I'm going to do.

Does calling to discuss a claim result in premium increase?

I had a minor, single car, fender bender (more like fender scraper) incident in a rental car in February. No other cars, no police, just scraped the front bumper on the wall in a parking garage. I received claim documentation from the rental car company last week, and the bill came out to about $1500. I'm working on deciding whether to put this on my auto insurance ($500 deductable). I'm interested in what (if any) effect this would have on my premiums. Obviously, I can call my agent to talk about it, but I want to say I saw somewhere that having a conversation like this with your agent is enough to trigger an increase in premiums - regardless of whether you actually file the claim or not. Is this true? Also - what is the likelihood of my rates going up for this? I'm with Allstate, have been for about 3 or 4 years with a homeowner policy, auto policy, and an RV policy. No claims or moving violations since I've been with them. Only one auto claim and only a few moving violations (all dismissed thru defensive driving) in the 12 years before Allstate. No history of delinquent payments. Great credit score. Any thoughts are appreciated..

My insurance company says me new car is totaled...

...but I am not positive that is true. The repair quote my claims agent gave me of $7500 is nowhere near the current value of the car, according to Edmund's and KBB. I just bought this 2008 Hyundai Son*ta four months ago and it is in excellent condition. The accident is still being investigated, but it looks like it I may be faulted because I can't prove that the other driver was speeding or that the traffic light had changed (no witnesses to confirm). So there it is. What options do I have to try to convince my insurance company to repair the vehicle instead? If that doesn't work, I am WAY upside-down on this car. I made the dumb mistake of buying a vehicle outside of my means w/ a low new car APR and I didn't get GAP insurance. I know...idiot. From what I understand, this basically means I'm screwed. I absolutely need a car for work that is reliable enough to travel cross-state. Will a dealer roll my loan into a new loan? Is that an incredibly stupid thing to do? I will be going back to graduate school soon and could, potentially, pay off my balance with education loans, but that is just delaying the debt... Help! Advice? Anyone that has had a similar situation...what did you do? I've learned a lot from this experience...that much is true.

Pushed into a car driven by an operator with a Suspended DL

Looking at my options here... I got hit while stopped at a red light. The person that hit me is at fault (documented in the police report and his insurance co [State Farm] says he is 100% at fault). The force of the impact, pushed me into a car infront of me. No damage to my car, slight damage to his car. The driver of this car was cited for driving on a Suspended DL. Can I put a claim against this person's insurance co, for BI? If this person had not been driving, I would not have been pushed into them. I am guessing the driver that hit me has the minimum 25/50/20 coverage required in VA. So the most I could get is 25K, correct? I can only find out what the true coverage is ... is by suing, correct? I was diagnosed with degerative disc disease over 5 years ago and have been pain and problem free for the last 5 years. Since the accident, I am constantly in pain and had to turn on the implant I have, to help manage the pain. I have not had to use this device in over 5 years... Since the accident I am back under Doctor's care for my back and now my neck, after being release 5 years ago...

Do I have to keep getting shots that barely worked?

I got the first of 3 stellate ganglion shots today. My hopes are all but dashed out. I barely felt any relief. They say I should feel relief (if they work for me,each person is different) almost immediately. Problem is I don't believe it worked. I can only see a little difference not enough to go through what I did and now I have the worst headache of my life. Question is they told me at the Doc's office that I would have to have a series of three before they could try anything else...this is demanded by the auto insurance company. If the first don't work well chances are neither will the second so why do I have to go through this two more times? Why would the insurance company want to waste the money on something that doesn't work, not to mention the fact it will eat up what monies I have available to me for med. care?

single vehicle accident

I was driving home at 3:30am yesterday and lost control on some ice and collided with a curb and a sign post. I was near my home and was able to drive the car home (damage to the undercarriage and the right door). I have filed my police accident report (there is a few thousand dollars worth of damage because a side airbag deployed and the exhaust and connected parts were damaged by the curb). I was NOT drinking at the time or at all on Friday. My question is how does the claims process work with regards to this? Will they assume I was drunk solely because of the time of day(the police officer seemed to have this mentality and repeated questioned me about it)? if so how much will they investigate it? As I was coming back from a friend's house whom i do not know too well, and her friends even less, will I be asked to track them down?

Accident at 4 way stop(w/ stop signs), i had the right away

Hi Community, I just found this website today, and have read a few posts, everyone seems very helpful, and I am in sure need of some help. Setting: Last Friday, I was involved in an daytime accident at a 4 intersection (with stop signs in all directions) in a residential area in Southern California. There is one lane for each direction. I was traveling southbound and came to a complete stop at the intersection. There we two cars to my right, going east bound, nobody coming from the south or east. The first car proceeded to onto the intersection, which meant it was my turn to go next. As I crossed the intersection, I look to my right side, and see the second car coming at me. I was already 2/3 of the way across the intersection as she started to go. She hit my rear tire and rear fender. The lady was elderly, and she was more hysterical when we first pulled over, and kept complaining that someone had hit her just a few weeks prior and that her she just had her car fixed. I called the cops to ask them to come out and write a police report, but at the time she apologized for hitting me and that she didn't see me. The cops asked if she was complying, I said yes, so they said they did not need to come out. We both said we would call our insurance agencies that day. I had a passenger in the car, she did not. We did not have any witnesses. Post Accident: I filed the claim with my insurance company. They told me that since I did not have comprehensive insurance and only liability, I would have to have a claims adjuster from the party's insurance agency assigned to me. They called the other insurance company to notify them of the claim. I called the other party's insurance following day to find out the progress, and when I spoke to the claims adjuster, she told me that her client had claimed she had the right of way, and is claiming no fault. At this point, I was flabbergasted because she had claimed fault at the scene of the accident and now she is claiming no fault. She was not very nice at all. I asked if I could have the phone number of her client so speak to her about the situation, and she exclaimed to me that it would be considered harassment on my part. I was very friendly to her on the phone the whole duration. I called my insurance company; they escalated it to a dispute. But my insurance company said that since I donÂ't have comprehensive, they can't do anything for me, but to fight the liability issue of it. He told me that I should go to small claims. At this point, he took my recorded statement, and said he will contact the other party, or try to (since he did not her phone number). The other party's insurance agency has not even called me yet. I have a few questions to start with. 1)What are my options at this point? The damage to my car is not too severe, but I do not think it is right for her and her insurance company to get away scot-free. 2)What happens to my DMV record, if the insurance companies can't reconcile? 3)What are the insurance companies doing now? I called my dispute claims officer and left a message; he did not call back. I don't feel like he is too concerned for me, because he is not fighting for me, but rather if they have to pay the liability. 4)Related to 2, Is my insurance going to go up if this isn't reconciled? I am really grateful if you made it down this far to read all I have written. I am only a 4th year college student, and do not have the resources to hire a lawyer, any help here would be greatly appreciated, and I thank you in advance. trying to settle inconvenience claim w/insurance co

My husband and I are in the process with the insurance co. to settle for our inconvenience claim. We were in the accident 4.11.07 I had back, neck, muscle, and sciatica pain. We couldn't do our normal activities over the summer like playing softball, camping, hiking, also the basic house keeping was difficult. We did go to chiropractic and the insurance co. is willing to pay for all my medical bills ($4,046.50) and additional $3,010.00 for my inconvenience. We told them that amount wasn't acceptable. They told us to come up with a figure my figure was pay my medical bills and additional $7,200.00 for inconvenience. They say they are unable to honor my request. My question is how can I get the figure I'm asking for or is what they are offering worth my andquot;on goingandquot; pain. My back still hurts when trying to wash my car, mow the lawn, weed the yard. And when I go walking my sciatica nerve hurts and it makes it difficult to walk.

I have three teenagers and car insurance!! UGH

OK Community...time to help out the ol' InsTeacher. I have three teenagers, a 16 yr. old daughter, a 17 yr. old son and a 19 yr. old daughter. I also have car insurance. The entire household has clean MVRs, and the 16 yr old and 17 yr. old qualify for good student rates, the 17 yr. old had driver's education. We are married, mult-car homeowner, and would like a multi-policy discount. Home has zero underwriting problems, and no HO losses ever (well, since 1989 or so). My car insurance rates suck, at least in my opinion. SO...here's the question! Do ANY OF YOU know a carrier (Pacific Northwest region) that gives decent rates for my exposure situation? 4 vehicles total, 2 full coverage/2 liability only. Carrying $500k CSL, 250/500 comp/collision deducts, UMBI @ $500k, 25k UMPD, plus the typical endorsements. All andquot;normalandquot; cars- nothing andquot;hotandquot; or collectors, etc. Hondas, Toyotas, VWs. Credit excellent, nothing on CLUE. I'm going crazy. Renewal date doesn't matter, I have no problem switching mid-term. I'm paying more than $4000 a year, and it's killing me. HELP!

Question about insurance from a European exchange student in

Hello ! I am an exchange student on F1 Visa in California and am having big problems with the DMV to to an incident that happened to me. Let me explain further : I am a student without a car (I ride bike to Uni and do all my stuff with bike) but decided to buy a car soon. I got my california license easily and prepared to save to buy a car. However in the meantime a neighbor proposed me to lend me his car because he had pity to see me bike everywhere for groceries. Remember I am 19 and HAVE NO IDEA ABOUT THE LAWS IN CALIFORNIA and NOBODY INFORMED ME OF ANYTHING. I accepted and drove the car to the supermarket. However one day I parked too close to one car and scratched a little bit of paint off the car (a red medium priced convertible). I discussed with the driver and told him I would pay him cash whatever he needed. I did not report the incident because I HAD NO IDEA I JHAD TO (we often settle like that in GERMANY ). However soon (1 month after)the DMV calls me and tells me to fill out a financial responsibility form for damages OVER 750 DOLLARS. I talked to the neighbor and he just said : andquot;oh my insurance doesnt cover you, work it our yourselfandquot;. (i cannt say if his insurance does cover me or not). Anyway I never thought the damages were over 750 Dollars and sent a request for hearing disputing the damages which has been approved. However then I received a letter from the insurance of the other party requesting me to pay 800 DOLLARS ! I talked with my parents over in Europe and they said andquot;just pay itandquot; and so I did. The insurance told me they would send me a release form or something and then I would be able to keep my license. HOWEVER (and here is the PROBLEM) I talked to DMV because I thought andquot;why do I need the dispute form because now I paid everythingandquot; but DMV agents told me if I CANCEL MY DISPUTE HEARING then I will certainly lose my license ! So...What should I do from now on ? I didnt cancel the dispute but paid everything to paragon insurance. (By the way, the insurance told me what had been paid for and Im not a pro but I still think it was too expensive but am not 100 percent sure). I am an HONEST student from Germany and dont want to lose my license for 4 years or I dont know how many because of a SCRATCH in the parking lot !!!! PLEASE HELP ME !!!!! Niki

2 Life insurance Headaches!

1. My mom and her live-in boyfriend of 20 years both passed away within 34 days of each other. He passed on 01/01/08 of natural causes. She was his primary beneficiary. My mom was capable of and did authorize the funeral home to be payed by the first (burial) policy. I had power of attorney over my moms affairs. She asked me to file a claim with his second life insurance co. I did so. My mom then passed away on 02/03/08. Is my moms estate the rightful beneficiary of the second policy or will it go to his brother the secondary beneficiary? 2. My mom was married to a different man in 1980. They went seperate ways but never divorced. My mom did not name a beneficiary on one of her policies. Indiana laws govern that it automatically goes to her husband. We have not seen or heard from since 1980 when they split. He physically abused my mother and her three daughters often when they where together. He is a homeless repeat sex offender in Washington State. Could I win if I contest his beneficiary claim?

Not At Fault

Hi! Today I had to swerve to the right to avoid a large car that had pulled almost completely into the right lane (which I was in) and paused in the road. I would have hit the driver's side door of the car, but instead I swerved to my right and went around the car, avoiding it. I did however, cause severe damage to my car by running into a ditch and probably totaled my vehicle. The other driver's car was not touched. The cops did not give either of us a ticket, but I think he absolutely should have cited the other driver for pulling into the road. I also have witnesses who told the cop that I he was so far into the road I would have hit him had I not swerved. Anyway, because no one was given a ticket, my insurance company says I am responsible to pay my deductible, and the damage is not even worth it to fix the car. I felt that I avoided a tremendously dangerous situation, but I am being penalized. Is there anything I can do to recoup the money for my car or to appeal this situation?

uninsured, underinsured auto insurance

Redoing my auto insurance through State Farm in PA. I am increasing my uninsured and underinsured coverage to $250,000 for each individual and $500,000 for each accident (I am doing this on both of the cars my wife and I own) and my agent advised me to andquot;stackandquot; the coverages. As I understand it that would essentially allow me to double each coverage ($500,000 individual and $1,000,000 for each accident) because I would be able to use the coverage from each car if I needed. The problem for me is the cost is so high and I already have what State Farm calls andquot;Qandquot; coverage for a million $ to pay for medical expenses and medically related costs in case of a debilitating accident, so I view this andquot;stackingandquot; as almost a double coverage I don't really need. I want to be covered in case of a debilitating accident (my wife does a good bit of driving for her job and we really depend on two salaries to pay for our living exspenses) but I feel this is overkill. Any advice would be greatly appreciated.

vandalism

my truck was keyed two weeks ago so i called the police and got a report. they told me to go and get and estimate so the can attach it to the report. so i went to the local body shop where the told me that allstate does there on estimates. so i went home and reported the claim and the set me up with an appointment with the adjuster. The adjuster wrote an estimate and took pictures and did what he needed to do, he said the only thing yet to do is give a recorded statement over the phone. So i assumed that was it. Prior to this happening i was car shopping. i now that i found a car that i wanted i figured that since the truck i am driving is 11 years old that it would not be worth painting. So i trade it in for a new car. So the next day i get a call and he asks fo the statement after thats done they tell me that allstate cant close the claim until they contact the police officer and take a second look at the truck. About a week before this happened i informed allstate that i am switching insurance companies so i dont know if they think this is a fraudulent case.

Wife got rear-ended at a light

Hi there, I've had a great couple of hours reading back through the archives at all of the stories and advice - seems like you guys are very helpful. Last week my wife and 5 month old were stopped at a red light in Oregon and got rear-ended by a Pontiac Grand Prix. The impact pushed her (1st impact) into a minivan, and that into a Grand Cherokee. Mitigating factors were time of day (the sun is directly in view in the evening there) and so the driver at fault was not cited but is still being held liable. Her insurance company (Allied/Nationwide) has talked to enough people (everyone but the occupants of the Jeep who got an attorney) to accept liability for the accident. My wife and son have both gone to the doctor's and been checked out, and both seem to be doing alright - my wife had a bump on her head and still has some neck soreness and the baby appears to be fine. My wife has also had a few headaches this last weekend, which may or may not be related. Our car however is probably totaled - it's a 2000 Ford Contour with 102,000 miles. The impact completely took off the rear bumper, both rear quarter panels and damaged the frame in the back where the bumper attaches. There is also minor damage to the front bumper. The cost of the damage and total value of the car are still being assessed, but my insurance adjuster (USAA) said I should be looking around for new cars. Hopefully that's enough background, on to the questions! First off - the Allied agent was here today and had a settlement offer for my wife and son. Allied has already agreed to pay (separate from any settlement) to replace the three car seats that were in the car, our medical deductible that USAA will want from us, and are providing a rental vehicle for the duration. Now for the settlement they are offering $250 for my son's pain and suffering and $350 for my wife's, with an additional medical allowance of any reasonable care, up to $3000 for the next month (for wife only). We don't really think that anything is seriously wrong with them, but are there any additional medical problems that could crop up down the road that we should be thinking of before signing? We don't want to be greedy car victims, but we don't want to be stuck with unpaid medical bills later on either. We have a month to accept this offer, after which she says they'll need additional proof of things (she called this an early settlement). So far I've been happy working with the insurance agent, but I also realize that her job is to save the company as much money as possible. Next question: how can I find out how much my car is worth, and how do I factor in things like snow tires and recent repairs? The tires that are on it now are literally brand new - I bought them the Saturday before the accident (which was Wednesday). It also has an upgraded radio, new speakers, and recent engine work. I'm worried that I'll be given their appraisal of my car's value and an offer to replace it and be forced to buy something in a hurry or start paying for the car rental myself out of pocket. It seems like there should be some way to claim andquot;pain and sufferingandquot; for the inconvenience of having to buy a car when it wasn't your fault that you need another one... Can someone get a money judgement against me?

Dear all, nice to have found this forum. I have a serious question that I need your advise. I was involved in a car accident recently and there were severe damage on my car and the other driver's car, the other driver also reported severe personal injury to both my insurance company and their own insurance company. I am thinking at I may be at-fault, but need to wait for adjuster's final investigation. I have full insurance coverage, my liability coverage for personal injury is 30000 per person and 60000 per accident and my liability coverage for car damage is 25000. But the other driver hired a lawyer saying that my liability coverage for both personal injury and car damage will not be enough, I think they are planning to sue me and ask for a lot of money, I am worried if they could get a money judgement against me and execute against my property, I have bank accounts, salaries, and a house under my name and my title, will they be able to get additional money from me by execute against my bank accounts, salaries, my house? I dont know what to do if anything....?

Over three months ago my Rav4 slid into the rear tire of a Ford F150 due to the driver's inability to stop in the snow. I live in CO and it was determined to be her fault so all the damages and a rental car were covered by her insurance, GEICO. The body shop took over a month to actually tow my car from my home to the shop and then it sat in the shop for a little over two more months before it was finally finished just this last Wednesday. Luckily, GEICO has been pretty good about their coverage and I have not had to pay anything. The body shop is my problem though... When I got my car back the gas tank was TOTALLY empty, it usually takes a little over 12 gallons when my car's light is on this time it took over 13 gallons to fill it up. I know this is trivial, but my car was not out of gas when it got towed to the shop and furthermore, where was it driven to? I would have let this minor thing slide had it not been for the fact that the very first day of having my car back it began to make a horrible, gravelly grinding sound every time we applied the brakes. I took it to the body shop and they claimed that its just wear and tear and I probably need new brakes. Sure enough, 400$ later I needed new brakes and rotors. My car was due for new brake pads when it went into the shop but there was no noise of any sort coming from my brakes when we got into this accident. I want to know what happened to my car for the two months it sat at the shop!!! Every week that I called I got a different story about when it would all be done and no one but the one guy assigned to me was ever able to tell me anything about the status of my car. Last Friday, when I called to check on my car for the umpteenth time, I was informed that the guy assigned to my claim was andquot;...no longer with the company...andquot; and then, miraculously, three days later my car is done. Long letter I know, but do I have any rights here? Is there any recourse that I can take? I have heard horror stories so of course my mind is reeling...any advice would be greatly appreciated. Friend driving jumped curb, possibly totalled my car

Hello - Recently, a friend was driving my car - I was in the passenger seat - he started driving like a jack-ass, skidded and jumped a curb. He is kind of an idiot, but so am I for letting him drive. He has taken reponsibility, and was working on having it fixed on his dime, but it looks like the damage to suspension etc is enough to effectively total the car. Although he is willing to pay a fair price for the car, I don't want to wipe him out financially. Should I just contact my insurance and explain the situation? The accident occured two weeks ago, will this present any problems? There is no police report since we were able to drive back to his house, and only later realized the extent of the damage. No injuries, no other property damage, no other people/cars involved at all. Any advice? I have a great driving record, and although he has offered to pay for increased insurance costs (which will be difficult to determine exactly) I don't want the this black mark on my record. HE HAD TO APPLY FOR DISABILITY FROM SOCIAL SECURITY.SOCIAL SECURITY DISABILITY GIVE TO HIM ONLY 643,00 A MONTH. MY HUSBAND HAVE NOT INSURANCE WHEN HE BECAME BLIND. MY FAMILY UNTIL TODAY HELP US TO PAY THE BILLS HERE. MY HUSBAND WRITE AND SPEAKS ENGLISH VERY WELL AND HE USED TO MAKE MORE THAN A 1000,00 FOR WEEK IN THE PAST. I THINK IS NECESSARY TO THINK IN THE FUTURE BECAUSE THE PRESENT BECAME PAST AND TODAY IS THE BEST TIME TO THINK IN THE FUTURE WITH DISABILITY INSURANCE BECAUSE IS SAFE. THE GOVERNMENT IS NOT GIVEN ENOUGH MONEY TO DISABILITY PEOPLE. BELIEVE ME OR NOT JUST 6 MONTHS AGO THEY CANCELED OUR FOOD STAMPS HERE. Insurance Fraud

Hi , My husband was backing out of a driveway and saw a truck coming down the street kind of fast. He decided to go up the driveway again to let the truck go through. Th etruck decided not to wait and squeezed themselves through anyway. He ended up scratching my rear bumper ( about half an inch) and doing some damage to his door. We called the police since he was being so dramatic saying we had hit him. The police said there was not enough damage to file a police report ( it has to be more thank $750 in damage ) We still exchanged info. He ende up reporting the andquot; accident andquot; to his and our insurance. The adjuster came out and took pictures of our vehicle. We tried renewing our insurance a year later and found out my husband was being held responsible for the accident.They paid the guys $1560 for damages. I cant believe they paid him that amount when the cops said it wasn't even 750 worth of damages to either vehicle. No one ever told us we were at fault. Now they are trying to make us pay $150 more a month for car insurance . Can they put you at fault without ever doing a proper investigation ?

How to settle car insurance claim?

Hi, my hysband had an accidenta few months ago and we had no insurance at that time. It was cancelled since we missed payment. We are in very bad situation financially. The other insurance co. sent us a letter asking for $3900 not sure how they come up with that amt. The car tt got hit is minor hit on the side. They threaten to send it to the attorney for collection and revoke my husband driving priviledges and report him to public safety. I have sent them letter like the one in this forum to settle for less but they did not want to settle. In fact they reply the letter and ask my husband to sign the promissory note to confirm the debt he owe for $3900 and return it within asap. I also asked for the appraisal / how did they come up with that amount but they never inform us. My questions are can we settle the amt for less, how to do it? If i choose to make payment i do not know how long it takes since we hardly have money left after bills, How to ask how did they come up with the amt? and usually will they provoke the DL if they report it to public safety? Cash pay-out

I'll try to make this as short as possible. I'm the victim of a parking lot rear end accident. The guy who hit me has admitted all liability. I've gotten an estimate at a shop of my choosing. His insurance company (AAA) sent out to my house an independent appraiser. She did her report but failed to include pictures of the most expensive damage (There's a difference of $500.00 comparing her report and the body shop that I took my car to). After I received the appraisers estimate I called AAA and they said that if I wanted a cash pay-out I would be the one responsible for getting the proof that the part the appraiser 'conveniently' left out was really damaged. This would be at MY expense. AAA, says that my bumper has to be completely dismantled to prove this. I say, BULL!!! U see, the problem is, it's my car that got hit. If the other party has admitted all liability I shouldn't have to pay a dime, not to mention that it's none of AAA's business if I get the car fixed or not. Am I right? BTW, Totaling the car out is not an option seeing as though it's worth much more than the damage caused. This is not in dispute. I live in California. Thanx in advance.

How to protect my assets as an underinsured motorist

My husband, daughter and I were involved in an accident last August 11, 2007 in Nebraska on our way home to Colorado. All of us ( including the other driver) walked away uninjured. The other driver stated he was fine. No ambulance was called. My husband lost control of the vehicle and it is a miracle we survived. The accident was my hubbies fault. We received a letter from our insurance company stating that there may be a demand for more than our policy covers. ($50,000) Upon contacting the Insurance Company (Shelter) they stated the other motorist has retained a very high powered attorney. The attorney has asked for our policy limits. The claims adjuster feels he may be trying to get underinsured motorist to kick in. He has $12,000 in injury claims so far. The other motorist is very obese and is a diabetic and is claiming an eye problem due to the accident . The adjuster feels this was a pre-existing problem and has requested his last 10 years of medical records. I AM SCARED TO DEATH. Is there anyway to legally protect our assets from him. My husband is the sole income for our family. We have no savings and some equity in our home. My hubby was seriously injured last winter on his way to work falling on all of the ice we had in Denver. ( Compound fracture requiring surgery) he also is scheduled for a hip transplant this summer. I worry about my daughter's future if we end up with a judgment against us. Hit & Run Street Racer will not reveal insurance coverag

Right after our son moved from Tucson, Arizona, to Washington state he was rear-ended by a hit andamp; run street racer at 70-75 miles an hour. Both cars were totalled. The racer and two buddies jumped out of their car and fled the scene. Luckily, my son had only minor injuries. Since the accident, the police agencies are doing nothing but bouncing our son around from the Washington State Patrol to the Pierce County Sherff's to the Puyallup Police Department. (I am married to a retired police officer and expected much more from them than that.) My son can't even get the insurance information from the owner of the car that hit him. The owner won't answer his phone or answer the door at his residence. Is there any other way to find out if this car is insured?...and if so, who it is insured by? The owner of the car told the police the car was stolen. Right! There is NO stolen car report filed. At this point, this hit andamp; run driver, who could have seriously injured or even killed my son is getting away with it. I don't like this! Our son's insurance company took care of his medical bills through his uninsured motorist bodily injury coverage, but you can't get uninsured motorist coverage in Arizona (he still had his Arizona coverage), which would have covered his totalled car. I can't express how frustrating this whole situation is. The guy driving this car needs to be held responsible for his actions. Any kind of help or advice about ANY of this would be greatly appreciated.

Dispute with Auto Insurance Appraiser

Hey everyone, I have some pretty serious questions/insurance issues that I need some help with. First a little background: About a month ago I was hit on my front left by someone who failed to yield the right of way. Her insurance company claimed liability and after 3 weeks my 2000 Ford Ranger was andquot;fixedandquot;. After bringing the truck home I noticed there was a small coolant leak. I had asked the Ford body shop to inspect the whole truck top to bottom as the impact was pretty hard. After hitting me she pushed me across a lane of traffic and we ended up in a grass area on the side of the road, and a sign was lodged under my truck Apparently Ford did not do this, thus me discovering the leak and not them. I took my truck to an very reputable mechanic in town, and right away they recognized that an impact had caused the damage. In their wordsandquot; natural wear and tear does not happen in this area, anyone who knwos engines should know this. An impact is needed to cause something like this. After contacting the insurance company, they sent the same appraiser who appraised the damage the first time. A little background about this guy. When he originally appraised the damage I asked him to look at the engine as the check engine light was on. His response was that as an appraiser he does not check the insides of vehicles, only estimates the outside damage and that he was not a mechanic. After checking my truck today, he said that in his opinion, after inspecting the engine, the damage was not caused by the accident. Everything he claims is in direct contradiction to a certified and very reputable mechanic. I asked him what exactly he was basing his opinion on, he mumbled something about a gasket and kept repeating, andquot;its my opinion and thats what I'm reporting to the insurance companyandquot;. He also claimed that a hard, front side impact in which a car that pushed a 3200 pound truck over a lane and into a grass area would have zero effect on an engine, which sounds completely ridiculous to me. So basically he had nothing to substantiate his andquot;opinionandquot;. Naturally I have contacted the insurance agency and disputed this, but now it is the weekend and I won't hear anything for a few days. So, I'm really just kind of curious how an appraiser who self admittedly is not a mechanic ,and refused to inspect an engine, comes to the conclusion that the damage is not accident related, directly contradicting a reputable mechanic. Is this their job or isn't it? I also find it interesting that with this added damage, the truck would have most certainly been a total loss as it is over $1000 in additional damage. Do I have any recourse here? I now own a truck that should have been totalled. Any help or advice would be appreciated. thanks Jon

Has any vehicle owner reading this forum ever been aided by a guaranty from the insurer on your collision claim? Did you find that a company that had agents were able to be of more help in resolving your repair issues? Did you find that you recieved more attention to your issues from a company that only sold their insurance online or from one that sold from local agents? What were you instructed to do when you complained about your repair to the insurance company? Did they offer to let you take the problem to a different shop or did they just simply tell you that you must take it to the original shop that made the original poor repair? Did you feel like you had no choice and the insurer insisted that you must use their preferred shop? Do you regret letting your insurance company select your repair shop or regret that you did not assert your preferred selection of a shop? What did the insurer or person on the 800 claim reporting number tell you when you said you already had a shop? When you informed the insurer that you already have a shop to do your repairs or that you had made a choice, were you talked out of it or told that they: 1. Could not work with that shop 2. That shop was not on their preferred list 3. If you choose that shop, we may not be able to get an adjuster out for a week or longer 4. We have had problems with that shop 5. We can not guaranty that shops work 6. If they charge more than we estimate, we MAY not pay more and you MAY be responsible for additional expenses 7. That shop takes to long on repairs 8. Your shop will have to pay for rental expenses if the repair takes to long. 9. We have had complaints on that shop. 10. That shop will not work from our estimates. 11. We can't trust that shop's quality 12. That shop has no Icar qualified technician with certificates 13. That shop does not have some equipment that we require. 14. Our guaranty only applies if you select one of our shops. 15. Anything not mentioned above If you answered yes to any of these statements, you have been a victim of steering. Insurers use this technique to get you to use a shop of their preference. Some insurers will say, we simply trust these shops. Many of these shops offer discounts on parts and labor back to the insurer; why would the insurer receive a discount on your repair? Many of these shops are required to use a certain percentage of used and cheaper imitation parts to remain on the insurer preferred list. Have you had problem that continued with the vehicle and taken it back to the insurer's preferred shop and have been told, we are finished with the work, the problem is in the loose nut behind the wheel? When you went back to the insurer did they help with their guaranty or did they simply tell you that you chose that shop from their list, they are not responsible? Did anyone have to go to an attorney or different shop to find the problem before the insurer would admit it should have been repaired? This one is a stretch but did anyone have any success filing a complaint to your department of insurance to force the insurer to allow you make the insurer pay for repairs at another shop to correct a deficient repair at the insurer preferred shop?

Did I mess up with my auto accident treatment?

Back in October I was the 4th car hit in a 5 vehicle accident over 1 hr from home. Immediately I had whiplash symptoms (very sore neck, headache). The next couple days got even worse. I refused treatment on the spot because I was heading home from a weekend workshop and it was my son's birthday. I talked to the police, the responsible party's insurance co, and even some of the other insurance co's when they called me. I had told all I was injured and that I would seek treatment. The responsible party was underinsured, so I contacted my own co and decided to use the pip for my injuries. But I really didn't understand it. They had made it clear that they couldn't guarantee it would not raise my insurance rates, although they said it very well may not. I did some research and found that was true for TX. With that, I went to a chiropractor recommended by a colleague. This place was different than others I have been to. The chiro gave me some paperwork and told me to get some xrays done. I was going in to see her 3 times/week. What with the accident and other things going on in our lives (including my husband's health issues) I completely forgot to do the xrays and she never reminded me, never mentioned them again. After about 10 visits I quit going to see her. I did feel so much better finally and was also worried. I knew my pip covered only up to $1500 and I thought we were about there. I was afraid to go over. Also, I ended up with a lot of anxiety about our insurance rates going up, and that was a huge influence on my not going anymore. It turned out that all that was billed and paid by my ins was $960. Then my insurance closed the claim, when I told them that I was feeling better, just some residual soreness now and then. They said that usually for soft tissue injury there are more visits. I said that I could resume them. She said that after a lapse (this was back in Dec, so only a month or so after I stopped going) the ins co may not pay for the treatments. So I decided not to do it. Anyways, I called the other day to see about negotiating a settlement, since right after the accident the responsible party's rep told me to do this when my treatment was done/I was ready. I realize it won't be a lot, but something. But then it finally popped back into my head about the x-rays. So I am just wondering if I will be able to get any settlement if x-rays weren't done. I would think so, just because many companies out there actually try to settle before a person even gets any treatment or care at all, even before x-rays are done. But then again, now after the fact, the ball is more in their court because they know what you have done and can see how limited it is if you have only had x amount of treatments, etc... So I am just wondering if anybody has any advice or ideas about this? I don't need to hear that I handled it badly. I already know it could be better. I can't go back and change the past. I should have been more proactive. I am not used to such a laid back chiropractor. I have always had my x-rays done on site and usually they remind you when they don't see them. Also, the anxiety I had about the insurance going up may have been silly, but legit, when they couldn't guarantee me it wouldn't happen. I don't want my rates to go up when the accident wasn't my fault! But I still think I should get something for my suffering and when my pip paid almost $1000. Thanks!

Value Variance for Totaled 1979 Mercedes

Hello - My name is Scott and I'm trying to help my Mother with an insurance claim. She has a pristine 1979 Mercedes-Benz 450 SLC, which was in an accident. It was not her fault, and she has witnesses that support her. Although she is 80+ years old, thankfully she was not injured, other than a bruised knee. However the car suffered substantial front-end damage and was called a total loss by her insurance. She bought the car new, it has 86,000 miles, and is in excellent condition. Her insurance company originally offered $4,500 and when she protested they offered $7,879.67. So she asked me if I would check to see what the real value of the car is. It's tricky since there are so few of these on the used car market. The NADA price is between $13,000 average and $17,900 high. The Gold Book of Classic Cars says $12,000 average and $16,000 excellent. The few used cars I found online were mostly in fair shape and selling for $6-7K. A couple in excellent condition were asking $12-19K but had only 30-50K miles. The insurance company says they do not use pricing guides, but pay according to the information they receive from CCC Information Services. They took their price, looked around for any used models they could find, and adjusted for mileage. The price they offered is firm and our only alternative is to exercise the Independent Adjuster clause in the insurance contract. I don't think of the car as collectable, but would like to get $10K or $11K which is only slightly more than the almost 8K offered. I would appreciate any guidance or suggestions on how to proceed. Of if this is most likely a fair offer. Thanks in advance.

Auto Insurance and who is at fault?

Hi All, I got questions for anyone or experts in auto insurance. My brother was involved in an accident a week ago. It was snowing pretty bad and my brother hit a lady in front of him who was trying to avoid another collision in front of her. She slammed the brakes and she was able to avoid the collision and my brother was not so lucky so he end up tapping her. She didnt have any damage on her car but my brother was left with cracked bumper. My brother reported to her insurance company since she suggested to call her insurance if there is any damage. Her insurance adjuster left a voicemail and said to fax the estimate of the damage. At this point, we were glad as we assumed she would handle the responsibility of this accident. We were gonna fax her the estimate today until we received a phone call from her stating that we should claim to our own insurance. Basically, she was telling us that it is not her client's fault that her client was only responsible for her own vehicle when she was trying to avoid the collision in front of her. In other words, its not her client's fault. So who is at fault then? what did she want to have the estimate in the first place? Can anyone help? Thank you.

I didn't know that GEICO deleted my comprehensive coverage

I bough my certified 2003 Toyota Corolla on April 24th 2007, and I insured my car with GEICO for 6-month comprehensive coverage, and indicated that the car is financed when I request the quota. As a general rule, any financed vehicle should take comprehensive coverage. On 9/9/2007, the policy was renewed automatically. And I always paid the premium online. On 2/13/2008and#65292; my car skidded on the snowy road (a pile of snow left on the middle of the road) and hit into the barrier, and evaluated at total loss by body shop. Police came and filed the accident, then I reported claim to GEICO---------- All at a sudden, I was told that I donÂ't have a comprehensive /collision coverage!! After further inquiry, they explained that they deleted the comprehensive /collision coverage for lack of photo inspection! How can they do that without noticing me! MY God, I never knew that I had been left unprotected until the accident happened! Nobody has ever informed me the change of coverage!! GEICO insisted that they sent mail to my previous address requesting photo inspection, but I moved from Binghamton to Kirkwood. And before my move, I did receive several GEICO advertising mail with Â"important informationÂ" printed on the envelope. Possibly, I ignored one or two mails from GEICO after I received the insurance package which included my coverage in detail. I recently transferred the title of a relative's car under

Another question is, in the state of Hawaii, who is liable in the case of a 3 car accident? In my statement, the person in front of my was at a stop, and as I was slowly approaching to stop behind him, the car behind me hit me and i propelled forward and hit the car. More damages were made to the front of my car and only scratches to the back but the insurance rep of the car behind me stated that my damages were inconsistent and that maybe i was the one who hit the car in front of me first and then the car hit me from behind. If that was the case, why didn't the person in front of me have more damages to their rear bumper (they only had minor damages)? Of course, I would get the most damages since I was right smack in the middle of the accident. Under my relative's insurance (GEICO), they want to investigate whether or not I was covered under the insurance, and if I wasn't covered, then if the fault was blamed on me then they wouldn't have to cover any damages. The other thing is that the insurance representative of the car behind me is also from GEICO and he had stated that they were going to be liable for my damages and told me to get an estimate. Now that they've seen my damages which is a total loss, they're claiming that my damages were inconsistent. This has really been stressing me out since I feel that I am getting screwed around with. I am presently on the receiving end of a claim

I was rear-ended while stopped at a light by a woman chatting on a cell phone as she hit me traveling in excess of 45 mph. Her big Buick had the front end smashed all the way back to the firewall. My foot was on the brake of my car, and when I noticed the skid marks from my tires, I realized her hit was hard enough to leave five-foot long skid marks from my tires. They have detailed information from my doctors describing my injuries, and pay logs showing that I lost thousands of dollars in lost earnings. Totaled! Less than 4 months old and <4K miles

The set-up: Minnesota 2007 Toyota Tundra purchased NEW 10/07 andlt;4K miles The accident: At work I park in a 2 level parking garage run by a valet service. The valet parks my truck in the basement level. There is a steep 40' ramp that connects the two levels. On the day of the accident, the valet drove my truck up the ramp, stopped at the top of the ramp, threw it in park (he thought), jumped out, and the truck immediately started backing up towards the ramp!!! The truck was in REVERSE! The truck raced down the full length of the ramp, all the way to the bottom where it wrapped the rear end around a 3' wide concrete pillar. The Parking Garage is taking FULL responsibility, and has turned it over to their insurance company. Estimate: Toyota Collision shop estimated repairs at $20,200 (replacing entire frame), and he says it came up as a total loss warning on his system. Now the Parking Garage Insurance adjuster wants to take a look for himself. I have a friend who works for Progressive who gave me a value of $30,900 using their system. 70% = $21,630 My questions: 1) I WANT this totaled. If the insurance adjuster decides not to total it, is there anything I can do? 2) If it is totaled, am I legally entitled to a settlement which puts me back in a BRAND NEW truck, since a similiar model with equal mileage isn't available in my area? 3) If it is totaled, am I legally entitled to a settlement which reimburses me for the aftermarket items (topper and bedliner) which I have reciepts for? 4) If it is totaled, am I legally entitled to a settlement which reimburses me for the difference between the old truck payoff, and the new truck financed (assuming its an equal truck)? Meaning, regardless of current financing rates, my payments would be the same and for the same number of remaining months. Thanks for any advice! NB

if the second driver admits fault or is found at fault will

help, we live in california, my 18 yr old daughter has had her license for 2 wks and has had 2 accidents. the first was at a 4 wy stop when she pulled out she thought the driver facing her was going straight also but unfortunately she was turning left in front of my daughter, pretty simple, my daughters fault right and our insurance pays. luckily not alot of damage on our car. the second accident was another 4 way intersection but no stop signs my daughter was getting ready to make a left hand turn and stopped for oncoming car, the other car stopped also and waived my daughter on, the other driver then turned around to talk to her passengers and then without looking back at the road first ran into my daughter after she had already started to make her turn, my daughter and neither of the other drivers called the police either time unfortunately. can my daughter have her license pulled? if the second driver admits fault or is found at fault will her insurance cover the damage to my car even though it had some superficial damage from first accident? is my daughters new license and/or previous accident a liability in second accident as i suspect? can my loan company decide to take back my car? can our insurance drop me? how do they determine fault if the other driver denies it?

Field inspector- meet at home or mechanic

Hi everyone... i was hoping for some advice on the following. I was just in an accident, it was the other person's fault and her insurance is going to pay for it, 21st insurance i think. I have a body shop that is owned by my best friends father. I am new to the area and know he will do a good job. He is not on the list of preffered shops, but i trust him. The field inspector was originally going to come to my work to look at the car, but my friend said as this was not my own insurance i was dealing with, i should have them come to the car repair shop to make sure they are going to be fair. This seemed like a plausible idea, as i have never been involved in an accident before and have no idea what I'm doing. Heres the wird part, after i called back to ask them to meet me at the shop, they stopped calling back. I havent heard anything about setting up an appointment, and then i got a call the other day from the other insurance saying they were looking into liability that i might share some fault (which i clearly don't). What is going on, and what should i do? Their reaction was very wierd. Should i not have asked them to go to the mechanic and just meet me at work?

Hit At Pump, Salvage Certificate of Title, Please Help

Hello, I'm Ark and new to the message board and have a question that maybe someone may be able to answer for me please. I have a 1994 Ford Van in good condition that we use for everyday use to and from work, grocery shopping, heck it's our only vehicle, so it's used for everything we do. I went get gas for my van and parked it at the gas pumps. I went into the store to pay and a car backed into my van. She had insurance and we filed the claim on the damage with her insurance company the following day and an insurance adjuster come out to our house to make an estimate on the damage. The adjuster left and told us she would call us on the next day to give us what they estimated the damage to be. The estimated the damage to be 1500.00 but would only pay 700.00 because of the age of the van and this insurance company says that the van is considered a total lost. Anyway, we disagree with their opinion and told the insurance company we wanted full payment for the damage so we could fix our vehicle...insurance company refuses and sent us this letter along with a check for 700.00. Dear Mr. John Doe, Enclosed please find a draft in the amount of $700.00, which represents the actual cash value of your vehicle, less the salvage value of $401.19. Since you have chosen to retain salvage to your vehicle, per House Bills 2151 and 2599, Progressive Insurance Company must notify the State of Texas that you have done so. The State of Texas will not allow transfer of title to your vehicle until a (specify either: Salvage Certificate of Title or Non repairable Certificate of Title) is issued. If you choose to repair the vehicle and apply for a new title, you must have the vehicle inspected at the DPS inspection station and pay a $120.00 inspection fee. Once you have the document, you will be allowed to obtain a new title which will state the vehicle was previously in salvaged condition. If you have any questions, please call me or call the Department of Transportation. PROTECT LOVED ONES

As we all wish to do, protecting those nearest and dearest to us is usually most important. Think about this for a second you just took out a $300,000 loan (which now a days is the lower end for homes especially in the NY area) to be paid off during a 30 year term. All sounds great until however tragedy strikes the family and the breadwinner either mom or dad fall victim to a heartattack, car accident etc. Banks may have lowered the rates on loans but unfortunately they will not be as sentimental to your current situation. So now you ask how will the family pay for this...Good thing at the time of closing their loan they spoke with their Insurance Broker about Mortgage Protection Insurance. This is basically a Term Life insurance policy that is geared to both the amount of your loan and the term in which it was taken for, or the amount of time left on it depending on when you decide to get it. This way if a loved one were to die the beneficiary usually either the significant other or eldest child can either pay off the balance of the loan, or re-invest the amount they just received from the Mortgage Protection policy. Premiums even for people in their later years of life are very low and are of course always worth the protection of family and loved ones. Who is at fault? I was hit, but my fault by technicality???

Who is liable in this case? Both in error. She hit me, but insurance wants out on a technicality. What happened: I pulled into a side street to enter a parking lot. There were two entrances one directly on the corner and one roughly 2-3 car lengths down. I took the 2nd entrance. It turns out that it was one-way, but was not well marked. I did not know until i had entered the lot. I pulled in slowly, only as far in as, maybe 2 car lengths. I realized it was one way, so I was planning to simply back into a spot on my right. This is when the incident occurred. I was stopped and a woman in one of the parking spots to my left, backed out, without even looking, right into my drivers side door. It hit right where my door meets the body of my car (2 door honda) Her car was fine. Mine was not. It should be roughly 800-1000 in damages as it is a new car. This was my first accident. She admitted liability at the scene, but there was no witness. We exchanged info and i called my insurance right away. I took a picture and emailed it to her that night. It was private property so no police. At first her insurance said they would take care of it. Now, her insurance is saying it is entirely my fault b/c of one-way parking lot, but she hit me! I did enter the wrong way, but i was not moving and had she looked in her rear view, i was directly behind her. She would have hit me regardless of the direction i was facing at the time. What rules/laws/regulations can i cite or find to say who is at fault? Even if it says I am. I just want to know. I agree that i was indeed in error as far as traffic laws... However, as for the actual accident, it had nothing to do with what way i was going. She had a clear view of me, and a clear view of the street i came from, it was a very open parking lot, and it wouldn't have mattered what way i was heading. She simply did not look behind her and backed up.

auto accident, rear ended

HI! I am from Iowa. On January 23rd of this year I was rear ended. I had just picked up my husband from work and was waiting at the stop lights. It was an intersection where you are able to turn right on red. However I am sure my light had just turned green. I looked both ways before pulling out into the intersection and saw nothing coming. After I cleared the intersection and was down the road a ways we were rearended. His van pushed us for a little while. I tried to get out of his way in to the median and then he t-boned us on the drivers side. My insurance company and every one else I have talked to said this was not my fault. However because a proper police report was not filled out his insurance is saying it was my fault. that I pulled out in front of him and refuse to pay anything. Is there anything legally I can do? If so who do I report his insurance company to. Because the other driver clearly hit me. Sincerely, Varb

Title Insurance

Does this make sense?? : FIVE POINTS: I don't do supplements, I do Final Bills and give them to my customer to pay in full. BECAUSE..... In my personal Opinion: Point - 1. The consumer has an agreement with the Repairer to repair their auto as discussed between the repairer and the car owner. Point - 2. The consumer has an agreement with the Insurer that says the insurer will pay for any covered loss, minus any deductible if applicable. Point - 3. The Repairer is not listed anywhere in the consumers Insurance Policy and has no rights or obligations with or to the consumer's insurer. Point - 4 The Insurer is not listed anywhere in the consumers agreement of repair with the Repairer, leaving the repairer with no rights or obligations with or to the consumer's insurer. Point - 5 The repairer has no automatic right discussing and/or modifying that repair agreement at the request of any third party, which would include (but not limited to) representatives from, insurance co.'s, bank's, law firm's, in-law's, grandma, etc. So... lets see. Who is my customer? The consumer. Who's responsibility is it to pay me? The consumer. If the actual repair is less than the estimate I wrote, who do I charge less? The consumer If the actual repair is more than the estimate I wrote, who do I charge more? The consumer. Just like most other businesses on the Planet..! I'm NOT a Claims Handler, I Fix Cars. Do kids need life insurance ?

I was reading an article this morning about life insurance and kids and was wondering what the community take on this is. The article is of the opinion that life insurance is not a good investment on kids but I have heard others say it was a good idea. Is it a waste of money. Would the money you spend be better invested elsewhere? Apparently the LA Times is publishing a mini series on this andquot;Title Insuranceandquot; thing. Today the title is andquot;The Trouble With Title Insuranceandquot; and a quote from it sums up a lot of what we have been posting here: : Consumer groups say policies are overpriced; home buyers have little choice but to pay : andquot;Unfortunately, what's happened in this industry is there's been a lot of illegal kickbacks and incentives that have been paid by the title industry to others to steer business in a particular direction,andquot; Poizner said. Title insurance is part of virtually every real estate transaction. It covers claims and legal fees for home buyers and lenders if problems arise -- even years later -- over ownership of a property's title. Defects in title include errors or omissions in deeds, mistakes in examining records, forgery, liens for unpaid taxes or contractor's bills, conflicting wills related to the home and missing heirs who suddenly appear and claim to own the property. Typically there are two title policies for each property: one to protect the home buyer; the other to protect the mortgage lender. Narrow Mountain Road

Arrgh! I just typed this all out and my daughter hit the power button on the computer and turned it off!!!!! So here goes again.... Please advise on this one! I am really worried about how this situation is turning out. Friday afternoon (3PM) my husband was driving home (in my parents company minivan). We live in a small mountain town west of Boulder in Colorado. Dirt road, hard snowpack. The plowing makes snowbanks on either side of the road, making the already narrow road narrower. My husband is taking a middle line in the road. Many places along this road are single lane this time of year and we all know the pulloffs etc. He is approaching a slight right-hand bend, slight uphill, when he sees a car coming the other way, pretty fast. First reaction is to brake hard, slides a short way, lets up and steers towards his snow bank slowing down at the same time. He is in control of his vehicle. He is going well under the speed limit (uphill I have to add so gravity is on his side). He is almost stopped, sallying up to and hitting the snowbank on his side of the road trying to make as much room as possible (absolutely no damage to our car). The approaching car passes, still on the road (since there is a snow bank on her side we can see clearly where she actually left the road). She leaves the road (approx 100 feet after they pass), meaning her right tire is on the other side of the snow bank, and she hits a tree that is right on the edge of the road. Car is not driveable. Later we can see that her skid marks start well before the cars pass and continue all the way up till she hits the tree (ie. she slammed her brakes, they locked, and she slid the whole way till she left the road). The width of the road we measured to be 14-15 feet where the cars pass. A car (including wing mirrors) is almost 7 feet. YEESH! The driver of the other car is a neighbor and a friend, I'll call her D. My husband parks his car at the top of our driveway, which coincidentally was only about 50 feet from where he stopped. Runs up to her to see if she's OK. Says she's fine, but is FREAKING OUT, she is in a big hurry, late for a meeting in Denver, says that an audience of 50 people are waiting for her, don't know the details. My husband immediately offers her our car (not parents) to drive, tells her not to worry about it, to bring it back the next day. I told him on Friday night that I was worried that this situation could get complicated and that if she said anything about fault, to simply say that he'd be glad to exchange insurance details with her. D and her husband come by the next day, she says that he 'ran her off the road'. Her side is that she admits that she was driving too fast, she says 30mph, but that he was 'in the middle of the road' and that he didn't move out of the middle, so she was forced to leave the road. She asks for 'our help', husband is a car enthusiast, and has repair body shop type connections, so he tells her he can help; meaning he can find a good guy to do the work, or help her tow the vehicle etc.. (we know that the car would be 'totalled' insurance wise, but if she wanted to keep it and get it fixed etc.) He mentions exchanging ins. details but she insists that she doesn't want to get the insurance involved. She clarifies that by help she means money, but hubby is not very straightforward, avoids conflict and is simply a nice guy all round' so he doesn't straight out say it's not his fault, or that they absolutely need to let the insurance handle it. At first it honestly didn't occur to us that this had anything to do with us, so we didn't think about contacting our insurance company. This was a single car accident and our vehicle was not involved. She went off the road well after the cars passed, she was driving too fast and not in control of her vehicle. We felt awfully sorry for her, and bad that it happened; but we don't think he's at fault. Are we mistaken? Today she called DH when I was at work, saying that she 'needs help' that she has severe whiplash, that her own policy won't cover! YIKES! What kind of insurance does she have that it won't cover her medical? An hour later DH got a call from her insurance company asking for his version of the incident. She informed us she filed a police report. We had not contacted our insurance, not filed a police report etc. But this is going downhill fast. I think from the way she's talking that we might hear from a lawyer soon! What is the best next step?

collision coverage on a new policy

hi everyone, i'm new here. =) i have a question about collision coverage. i was at a drive-thru banking center earlier (02/06) and pulled in to the rightmost lane. the lady at the window told me to move to either of the two lanes to the left of me. so i reversed the car far back enough for me to drive into the lane to the left of me. unfortunately i miscalculated and as i was driving into the lane i brushed against the thick pole to my right, so i reversed the car (which probably made it worse). there's a big dent on the rear door and large scratches extending from the rear to the front door. collision insurance should cover this right? thing is, we had just switched TO a new insurance company from a different insurance company last february 4th (policy effective 02/04). the photo inspection was done 02/05 (no damage whatsoever yesterday). is the car covered? they might say that it isn't since we had just switched. i'm so worried. another thing is that even though the car is insured under my name, it is currently registered under my mother's name. our new insurance company said that i had 30 days to transfer the registration to my name. i did add my mother under my policy (as a non-driver) the other day but when i called in to check today, it was only under the andquot;notes.andquot; so they added her again but said that i'll be seeing her name online in about 24 hours. i haven't reported the incident to my insurance co. yet. is the collision covered under the policy? also, is this considered an andquot;accidentandquot;? will it raise my premium? thanks in advance.

what kind of car insurance and for who

Hi I'm trying to figure out who needs to get insurance on a car and for how much? Ok I inherited a car-that I am not going to drive (its a straight drive) I know I should just sell it but I don't want to yet. I think I am either going to let my boyfriend (30 years old) or my little bro (18 years old) drive it or possible they can share. It is a crappy car but it gets good gas mileage. I now have a lot of assets I need to make sure are protected...ie if they get in a wreck I don't want to be sued. Both boys will dog this little car, I don't trust either one of their driving. However, I think just sitting in the driveway probably isn't good for it either. What people need to be insured and what limits should I get. I have my own policy, my boy friend has his own policy and my little bro shares a policy with my mom and step-dad

Insurance company slaking

I had my 2006 chevy colorado stolen on dec. 23, 2007 from the backyard of my in-laws house. It was found 11 hours later in the marshes and it had water all in the cab and a water line that reached the top of the bed. The police said they had a string of thefts lately and it was possible that could be what happened. I had left it unlocked since it was a safe place(so i thought) and i always had my spare in the glove box since i had a history of locking my keys in. nobody knew this but me and my wife. i was told i would be contacted by an adjuster by jan 1. well i didnt hear from him till the 4th, then i was told i would be contacted by an investigator by the 4th. that didnt happen untill the 12th. on the 25th, they told me that they chose to do an EUO and i would be given a phone number for the attorney to set up my appt by the 28th. today is the 4th of february and i have not heard from the since. I had looked at getting a replacement vehicle the whole time and was told i couldnt get a letter stating they were taking over it untill after the investigation. well, on the 9th of jan i found a vehicle and the dealer called and they sent the letter. so on the 25th they said they wanted to go thru an attorney, even after i got a letter saying i had no interest in the vehicle anymore. I spoke to a military attorney today and they said i may want to look into suing the company. any suggestions or advice. Im also getting ready to go on deployment to afghanistan and when i leave i cant do anything.

Comp Settlement

Just had a nephew go through a year of compensation hearings, he was hurt on a drilling rig and ripped his rotator cups, he can not do this type of work anymore so he is going through the office of vocational rehabilitation to get retrained in another field that won't be as laborous and won't affect his injury. He was initially promised around $80,000, when it was all said and done he got $40,000 and the attorney took 33% of that. He settled out last week and is moving on with his life. I am curious as to how a settlement is chopped up like this, this don't even cover his wages for the year. The wage and the availability of overtime he would have worked which they could have verified through his wage record would have been over $45,000. It is all done now, the paperwork signed and I am sure the check is on it's way. I am just curious about how they can chop it up, where you end up with half of the initial offer, makes you wonder, should you jump at the first offer and let it go.

How to settle injury claim with adjuster?

I have a landlord who left a 6inch pipe sticking out of the ground infront of the porch. He was obilgated andamp; had the duty to fix under nys landlord andamp; tenant law. I recently sent him another demand letter stating to inform his insurance co. The accident happened april of 2007. He was hiding from his insurance cause he was at fault. Will his insurance company at least look at that. Im now in contact with an adjuster how do i settle my claim. I know people sometimes dont use lawyers cause we know they are in it just for the money. And plus with proper documents i think i can settle it. Could you tell me whats things i can do to settle and get it out the way? I had to get surgery because the nerves in my hand and wrist was damage. And it cause me to have radial nerve damage. I had an appt today to get an emg test. The doctor stated it was most likely permanent. Can feel anything in my hand and wrist at times. But part of my hand as no senation and numbness all the time. I also chronic pain and weakness in my hand and wrist most of the time. im fairly young and have to deal with this for a long time or even forever. What do you think my claim is worth. Over 9grand in med bills. Should i create a well organized settlement package with all my supporting documents andamp; etc. And also if i should do that should i put a amount in the package or let them make the first offer. I know people settle with adjusters but what documents do i need for him to give me a fair offer? Thank you for your time and help. Please Advice. Have anyone ever done this before?

FOX news article brings up question

Yesterday FOX news was reporting that Time Warner Cable was billing tornado victims for damage to cable boxes and equipment due to the tornado. Below is a quote from the article: : WHEATLAND, Wis. — Having a tornado demolish her home was bad enough. But when Ann Beam received a $2,000 cable bill a few weeks later, she was floored. andquot;I just couldn't believe it,andquot; Beam said. andquot;I was like, 'What are they thinking?'andquot; Time Warner Cable billed a number of Wheatland residents for equipment destroyed in the Jan. 7 twister that struck the southeast corner of the state. Beam's bill covered five cable boxes and five remote controls. She immediately called the cable company, but a man who identified himself as a manager said there was nothing the company could do. andquot;They said I would have to take the bill and turn it in to my insurance company,andquot; Beam said. But her cable equipment was nine years old, and the insurance company would pay only a depreciated value that wouldn't cover her bill, she said. Now Time Warner also states that this was a andquot;mistakeandquot; and all the customer has to do is call them and they will take these charges off their bill. However, this does bring up a question about the andquot;Act of Godandquot; clause that many insurances have. And my question is (in light of this recent news article), If your insurance company refuses to cover some claim to your property under this andquot;Act Of Godandquot; clause but some one else's property get destroyed as well are you responsible or does this andquot;Act of Godandquot; clause relieve you from responsibility also? It does not seem fair that some event happening that you could not control and is also a legal way out for large insurance companies to keep from paying a claim would leave you still responsible for some repair or replacement of other's property that might be affected but somehow I think the homeowner might still be held responsible. In this case it appear that Time Warner did not want the bad andquot;publicityandquot; associated with the news that was being reported about this so they said it was a andquot;mistakeandquot; but from reading the article it appears to me their original intent was to collect damages from the individuals who had their services and who's boxes had been damaged or destroyed. Anyone feel like weighing in on this one?

Question about Old Accident

Ok, it's been a few years since this accident happened, but I had no access to a forum like this at the time. I thought what happened was wrong and just wanted some opinions. I live in Florida as far as any insurance laws go. (We are a andquot;No Faultandquot; state.) My fiancee was driving southbound coming to pick me up from work. A teenager pulled out from a sideroad turning left to go North. My fiancee slammed her brakes but didn't have enough time to not hit the kids car. She clipped the back edge of his car and the front of my car was pretty smashed up. Neither her or the teen had any damage. (Funny thing is my dad met me there and the kid ended up being one of his students.) The police found that the teen was pretty much more at fault, so it was going to be his insurance paying damages. He had Mercury, I had Geico. I talked with his insurance a few times and they talked to my fiancee. She didn't think about it and told him she was going a few miles an hour over the speed limit. (It was only like 3-4 MPH, but OOPS!!) She also told him there was a turn lane to her right, but how was she supposed to think that fast? Anyways, they decided they'd pay 60% of it and if I wanted more, my insurance could pay the rest. After talking with my insurance, they offered to send their adjuster to look at it so I wouldn't get screwed by Mercury. I agreed to do this. I regret that. It wasn't their insurance that screwed me. The gentleman that went to look at it called me back and gave me the estimate but said he should have the car towed to where Geico takes them. I told him and the storage place no because Mercury was supposed to tow it to their adjuster...Geico was only giving me a backup adjustment. This guy was a total jerk about it saying he knew what he was talking about and that it was his call. I went to the storage place and signed my car out to Mercury to pick up and told them that Geico was NOT to take it. What do they do? Release it to Geico. The moron working at the storage place (who showed no paperwork of my car coming the night before by the way) ended up calling me and telling me I released it to the wrong company, but they gave it to the right one. They then called up my fiancees cell phone trying to find out who she was. MORONS!!!! Anyways, I gave Geico my information on my car's leinholder and they were going to take care of it and get their money back from Mercury when the time came. They repeatedly told me they couldn't get ahold of my leinholder. The guy and car company were shady to begin with, so I just assumed that he disappeared or was in jail or something...so I tried to get info on where he went through the state like Geico told me. Almost a year later, I was like, andquot;What the heck? Let's try calling the car dealership he was based in and see if they have info.andquot; What do you know...he was still THERE!!!! So I called Geico again, gave them the number once more and got it settled, got my car paid off and got a big $600 check after they took care of the storage fees. (Even though storage was worthless.) Am I the only one that can't believe these fools?

What should i settle for?

was a 22 year old passenger in a single car accident that broke my femur which resulted in 3 nights in the hospital and sugury to place a rod and screw put in my leg. I was off work for 3 1/2 months and had to go through a month of theropy before returning to work. Medical bills approx. 30k, and lost wages of around $4500. I am almost ready to settle with the insurance and would like to know where to start? What kind of settlement am i looking at? I was wondering where to start when the offering comes.... does it matter if he was drinking and driving and driving wrecklessly? didnt get a DUI though, got physical control. His coverages is 100 300 50...i would like to know a round about estimate of what I am expected to get so I know what to settle for. I talked to a lawyer and she said go for the limits...so after my bills that would leave about 70k, would the insurance settle for that?

A family of four pays nearly $3,300 in insurance premiums each year, according to Kaiser Family Foundation, a nonprofit health policy and research firm. Tack on deductibles, co-payments, prescription drugs and uncovered services, and the bill is closer to $6,700. Some relief is being offered by a surprising source: credit cards. Now, consumers can earn cash for their health-savings accounts, and discounts on prescriptions, as well as dental and vision care by paying for their medical expenses with plastic. Bank of America offers two such credit cards. Citibank's card offers discounts of up to 60% on prescription drugs. HSBC is market testing a debit card linked to drugstore CVS's Extra Care rewards program. Even Target is in the game, offering a 10% discount coupon for every 10 prescriptions filled and paid for with your store credit card. : Used wisely, however, these cards can offer decent savings for cardholders. With the Citi Professional card (see chart), for example, an uninsured consumer could pay just $158.45 at CVS for a 60-dose disk of asthma med Advair and#8212; a 12% discount off the regular price of $180.99. Assuming the inhaler is used twice a day, the savings would come to $270.48 over the course of a year. With the Aetna Healthy Living card (see chart), the average $2,081 paid out of pocket to heal a compound leg fracture would garner a $25 rebate check. It appears that CVS Drugstore is one of the test markets for this.

Another beneficiary contestment

Hi guys, As you might know I am contesting the beneficiary change (from 1995) of my late father (I was his original beneficiary). Currently, his ex wife (they divorced in 1999) is listed as his beneficiary. I believe that I was change back to beneficiary in 1999 (the year they were divorced and the year I turned 1 and that either the local represenative or the home office has misplaced this amendment and never had it recorded. The insurance company said that I can also file a claim for the policy even though I am not who they show as beneficiary. You see I have the original policy and I am his only relative therefore I am supposed to be the only person who can get certified death certificates. They of course want me to send them these things. Does this sound fishy to anyone else? I am kind of wondering how hard they are really going to look for the andquot;lostandquot; amendment? If it is found would they not be considered negligent for losing it and making me go through all of this? Also they sent my attorneys a copy of the beneficiary form that changed my dad's ex-wife to beneficiary. It also looks a little strange to me. My step-mother filled out the entire form. My dad only signed the bottom. Also he checked boxed to change the billing address and the beneficiary on the same form. I would hope my step mother would not have done this but at this point I am not putting anything past her. How do I know that my dad didn't think he was signing a change of address form and then she went back and changed herself to beneficiary before it was mailed off? I mean this women truely is evil and she knows this money is intended for me (my father's only child and basically his only living relative) Also would this matter to a court. I have a hand written letter from my step-mother that she wrote when she left my father. My dad had to go out of the state for a week for training for work. I was 17 and was staying at home with my step mother. I went to school on Mon. and when I came home there was nothing in my house except for this note. She took all the furniture, the dishes, even all the food. It was this note and a phone in the floor. In the note she repeatedly states she doesn't want anything but what she has already taken. She goes on to state that I won and now I have my daddy's time, house, and money. Does this letter mean anything? She also requests him to lie (which he did) and say they have been seperated for a year so that their divoce would go through immediatly. They were only married for 3 1/2 years.

I don�t want the Ins co. to total out my cash car.

I live in Dallas TX and drive a 1995 Grand AM SE 4 door Power doors and locks. I paid $2000.00 for the car in 2006. I can�t afford a car note at this time. I was hit by this cowboy in an F150. He was at fault and his ins co. has accepted liability. (by the way his truck is just fine) It will cost $2160.00 to fix my car according to his insurance company certified repair company S-King. The only damage is to the front drivers side panel, bumper head light and hub cap. My car is drivable and runs just fine. The Ins co. wants to total out my car and give me $800.00. l I cannot buy another cash car for $800.00 which means if I give them my car, how will I get to work? Pick up my kids LIVE MY LIFE! I refused and told them I want to keep my car and that they need to pay for Cowboy negligence. Do I have to give them my car and take the $800.00? Can I make them repair my car? I was minding my own business when I got hit by the cowboy and now Farmers Ins it trying to put me I the poor house. Stressed.

Wife in Car accident, we have no insurance, help!?

Here's my situation, I have no help/advice from anyone on what to do, so I need legal type advice! We live in Florida. My wife got into an accident last week, and her can was undrivable from the scene. NOBODY was hurt. THe other driver was able to drive the car away from the scene. My wife was entering an intersection, where another driver signaled her to 'go ahead' and she procedeed to turn into the intersection, when another driver hit my wife's car. The officer arriving on the scene gave my wife a failure to yeild ticket. The other driver received a ticket for statute FL322.34(2) DNLS knowingly, which seems to be for driving with a suspended license (for a DUI or something similar). My wife called me about the accident and it turns out that after calling my insurance company (progressive) we had missed a payment, which coincided with the end of a policy/start of a new one. They never sent a missed payment notice, because one policy(6mo period) expired and there was no missed payment notice to send becuase we had not started our new policy without that 'missed' payment, so we were informed that we were uninsured during the period of the accident (totally unknown to us, and unfortunate for us). So, the owner of the other vehicle (not the driver) wants us to pay his $1000 deductible for the accident, which of course we don't have. I'm not sure how to handle this? Are we totally responsible for 100% of the fault here?? Does she get assigned any percentage of the fault due? What about the fact that she was driving with a susupended license and shouldn't have been on the road at all? Can someone help me with answers to those questions? Thanks! captainejo@hotmail.com
